How do I ensure that I am legally compliant?
We help ensure your background check process complies with the law.
We’ll work with you to make sure your background check process meets federal, state, and local regulations. We’re happy to answer questions and provide sample forms, but we don’t give legal advice. For complete compliance, we recommend consulting with legal counsel to review your screening procedures.
How long does it take to complete a background report?
24 to 48 Hours
When you place an order, we’ll give you an estimated completion time. On average, reports take 24 to 48 hours to process. As results become available, you’ll be able to view them directly in your account.
Do I need an employee's consent to run a background check?
Yes
Under the Fair Credit Reporting Act (FCRA), employers must obtain written consent from an employee or job applicant before conducting a background check.
This consent ensures that you:
- Informed the employee (or candidate) about the screening process.
- Notified them of their legal rights in case of adverse action, ensured privacy, and prevented discrimination. We also recommend using the adverse action and pre-adverse action forms.
- California Law: Employers in California must obtain consent every time a background check is run.
What information is necessary to run a background check on a candidate?
Legal name, current address, date of birth, social security number, and email address.
If we need additional details, we’ll reach out to you directly.
What if I don't have some of the necessary information about a candidate?
We need all required information to proceed with the background check.
Our solutions integrate with HRIS and ATS systems, so you can opt for candidates to provide their information during the application process.
Will you explain the adverse action process?
You must give them notice.
If your company takes adverse action based on a background report, you must provide notice to the individual. This informs them of their rights to review the reported information and correct any inaccuracies.
What if I want to dispute information on a background report?
